Many people assume foreigners cannot own property in Thailand. The reality is that foreign nationals can legally own a condominium unit in their own name, with full freehold title, under Thai law.

What Is the Foreign Quota?
Under the Thai Condominium Act, foreigners can collectively own up to 49% of the total sellable floor area in any single condominium project. The remaining 51% must be Thai-owned. This is a hard legal requirement — not a developer policy.
The quota is calculated by floor area, not by number of units. This means a larger unit takes up more of the available quota than a smaller one. Always confirm quota availability in writing before signing anything.
Two Ways Foreigners Can Own a Condo in Thailand
Freehold — the most secure option. You own the unit permanently in your own name, with the same rights as a Thai buyer. You can sell, rent, inherit, and repatriate proceeds. Requires the unit to be within the 49% foreign quota.
Leasehold — a long-term registered lease, typically 30 years with contractual renewal options up to 90 years. Lower entry cost, no quota restriction. Renewal beyond the first 30 years is contractual — not guaranteed by statute. More common among short-term investors.
Step-by-Step Buying Process for Foreign Buyers
Step 1 — Choose a project and verify the foreign quota
Before signing any agreement, request a written confirmation from the condominium's juristic person stating the current foreign ownership percentage. Do not rely on verbal assurances. The document should be dated within 7 days of your inquiry.
Step 2 — Transfer funds from overseas in foreign currency
This is the most critical legal requirement. Thai law requires that purchase funds must be remitted into Thailand in foreign currency — USD, GBP, EUR, SGD or equivalent. The Thai receiving bank will issue a Foreign Exchange Transaction Form (FET Form). Without this document, the Land Office will reject your ownership registration.
Important: if your money is already in a Thai bank account, it must first be transferred back abroad and then remitted to Thailand in foreign currency to generate a valid FET Form. Contact us for more details.
Step 3 — Review and sign the Sale and Purchase Agreement
Read the contract carefully. Key items to check: payment schedule, transfer conditions, penalties, and the condominium's bylaws regarding rentals and renovations. Independent legal review is strongly recommended before signing.
Step 4 — Register ownership at the Land Office
On transfer day, both buyer and seller attend the Land Office with full documentation. Ownership is recorded on a Chanote title deed in the foreign buyer's name. Do You Need a Thai Bank Account or Visa?
No specific visa is required to buy a condo in Thailand. Any visa type is acceptable. Ownership is not tied to visa status. A Thai bank account is not required for the purchase itself, but is practically useful for paying maintenance fees and receiving rental income.
